AGREEMENT WITH DUPONT WORLD TRAVEL & TOURS, INC

Before we make arrangements for your flight, hotel, car rental, tour, cruise, or other trip, your replying to our emails will signify your agreement with the following terms and conditions:


DUPONT WORLD TRAVEL & TOURS, Inc. (“Dupont” DBA as Dupont Travel Network) acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”).  DUPONT is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.


  DUPONT assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under DUPONT’s control; and (4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. You hereby release DUPONT from all claims arising out of any problem covered in this paragraph.


  Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. By replying to an email from the www.traveldupont.com domain, you are consenting to those terms and conditions.

If DUPONT is the merchant on your credit card transaction, you agree to the following: DUPONT’s services consist of facilitating the sale and paying the Suppliers, and once DUPONT provides said services, you agree not to dispute the credit card charge. If a Supplier does not provide the service or ceases operations, your only recourse will be against the Supplier. If a Supplier goes bankrupt, your only recourse will be to file a claim with the Supplier’s bankruptcy court.


DUPONT has no special knowledge regarding the financial condition of the Suppliers,, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.  For information concerning possible dangers at destinations, DUPONT recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov.  For medical information, DUPONT recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel.  You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s).  You hereby release DUPONT from all claims arising out of any problem covered in this paragraph. You agree that the courts in {county name} will be the exclusive jurisdiction for all claims brought by you or DUPONT, and you hereby submit to the personal jurisdiction of those courts.


 

TERMS & CONDITIONS of PURCHASE 

 THIS IS AN AGREEMENT. This is an agreement between you (“The Client”) and Dupont World Travel and Tours, inc (“The Agency”). This agreement is referred to as this "Purchase Agreement". This Purchase Agreement governs your credit card authorization of purchase, via email, of any goods or services from The Agency and including orders placed through the agency's website www.traveldupont.com.  This includes, but is not limited to, any web site associated with The Agency.     

Your submission of any order for the purchase of any goods or services through a Dupont World Travel and Tours’ Web Site, email, telephone, fax or verbal order constitutes your acceptance of the terms of this Purchase Agreement, including any applicable additional terms. Any email sent or returned to an email affiliated to “The Agency” that contains your name constitutes an authorization for the Agency to charge the credit card you provided the agent/affiliate.
If you do not agree with any of the provisions of this Purchase Agreement or with any of the additional terms that are a part of this Purchase Agreement, do not make a purchase. If any terms of this Purchase Agreement that are not additional terms conflict with any of the additional terms, then the terms of this Purchase Agreement that are not additional terms shall control.
Orders are received from you on or through "The Agency" on the condition that you accept all of the terms of this purchase agreement without modification. your submission of an order constitutes your acceptance of this agreement without modification.

Fares: All airfares including taxes and service fees are non-refundable or at minimum carry a non-refundable portion. All prices are in US dollars unless otherwise stated. Any price increases occurring after issuance of travel documents are the responsibility of airlines and are subject to change without warnings from the airlines.

Baggage Allowance and Restrictions: Baggage fees are not included in the cost of your trip. Baggage Allowance and Restrictions will apply to all airlines and are subject to change at any time. We recommend that you check with the airline you are traveling with to verify the specific baggage restrictions or ask one of our agents to find it for you. Contact Phone numbers for most Airlines are available by clicking Here or you may visit the individual airline's website for most up to date baggage information. Recently, luggage weight limitations have been further reduced and some airlines will charge fees for checked Baggage even when operating on a code share agreement. Air Canada 4 digit flight numbers going to/via USA or International destinations are code share flights & will be subject to the operating carrier's baggage allowance and fees. Please check with the operating carrier for their Baggage guidelines. You will be charged additional fees each time you go over the size and/or weight allowances. Please note that fees for baggage are paid for directly to the airline and can change at any time. baggage fees are per person, per direction unless otherwise stated.

Passports/Visas/Health Requirements: Prior to booking your trip, you should ensure that you meet the passport, visa, affidavit, health and other requirements of the countries you wish to visit and those that you transit (even if it is for a plane change). US Citizens are required to present a current valid US passport for entry or transit through most countries; otherwise, entry or transit may be denied. We remind you that living standards and practices at your travel destination and the conditions there with respect to the provision of utilities, services and accommodation may differ from those found in the US. Please check the State Department's website for visa information or our site at www.TravelDupont.com and click 'travel toolbox' for all entry/exit requirements, travel tips and local health information. Please note that many countries require that your passport be valid for a period of (a minimum) six months beyond your return date. We accept no responsibility if you should be denied boarding or deported for any reason including your age. You, the customer must be eighteen years of age. If you are purchasing travel services for a customer that is not the age of majority in the applicable jurisdiction you must contact our call centre to arrange the purchase.

Entry Requirements For United States: The department of Homeland Security of the United States of America has introduced new laws effective January 23, 2007 governing the entry requirements to the United States by air. These new laws include mandatory passports for all travelers including Canadian and American citizens. Please ensure that your passport is valid for at least 6 months past your desired return date to ensure that there are not any delays in regards to US Immigration. Please take the time to review the website link for the Department of Homeland Security at: www.dhs.gov/xtrvlsec/crossingborders/whtibasics.shtm. If you have any questions about this, please do contact us and we will explain this further for you.

Insurance: We strongly recommend travel insurance to cover you for cancellation, health, baggage and other losses including out-of-province health insurance, if applicable. For every sale, Gala Travels offers the option to purchase travel insurance to cover the customer against any unforeseen circumstances that may occur prior to, during or after your trip. It is the customers’ responsibility to read and familiarize themselves with the travel insurance policy to understand what their purchased travel insurance covers and under what conditions. If the customer wants to make an insurance claim it is their responsibility to either contact the applicable Insurance Company directly as soon as possible. Please contact us if you require more information regarding travel insurance.

Cancellation / Changes: If you need to change or cancel your travel plans, it is your responsibility to notify us in writing of such a request. The tickets we issue are discount tickets, which have restrictions on them and may be up to 100% non-refundable and non-changeable. Therefore you should assume all reservations are non-refundable the moment you make the booking. We charge a service fee for any changes or cancellations to fares. In addition to our charges, most airlines also have a penalty or cancellation fee for any changes or cancellations to fares. Customers who do not appear or 'no show' for their flight will forfeit the entire fare paid. If you arrive at the airport late or are denied boarding, you will forfeit the entire fare paid.

TICKETING & REFUNDS

Once a ticket has been issued, it is non-refundable. Changes are subject to fees.  

A passenger missing a flight is considered a "no show", which is non refundable.

A passenger denying credit card charges of an issued tickets will result in a $250 fine for ilegally having funds witheld.

Frequent Flyer Programs: Most our Airfares allow accumulation of frequent flyer miles. You may enter your frequent flyer program at the time of booking or advise one of our agents to update the number in the booking. Your frequent flyer information is sent to the airline once your ticket is issued.

ONLINE FARE RESERVATIONS, MISPRINTS, AND PRODUCT AVAILABILITY

In the event that more than one set of conditions apply to the same trip then the most restrictive conditions of both sets apply to the entire journey. While it is possible to make bookings electronically for some of the travel services, the act of reserving a product electronically does not imply a final confirmation or commitment by Dupont World Travel to actually deliver the product reserved at the prices indicated. Dupont World Travel endeavors to provide current and accurate information on its website, however any misprints or errors may occur. Accordingly, Dupont World Travel reserves the right to change the prices, fees, charges regarding the goods and services available on its website at any time and from time to time without any notice or liability to the user or any other person. Also, Dupont World Travel cannot guarantee that goods and services advertised on the website may be available when ordered or thereafter Dupont World Travel reserves the right at any time to reject, amend, cancel or terminate any order without prior notification. 

 LIMITATION OF LIABILITY AND DAMAGES

You agree that Dupont World Travel and Tours will NOT be held liable for any damages of any kind arising from the purchase or use of any products or services purchased through, or information available on or through, employees, consultants or affiliates of "The Agency" including, but not limited to direct, indirect, incidental, punitive, special or consequential damages (including but not limited to lost profits, lost savings, loss of use or loss of data), whether or not advised of the possibility of such damage, and regardless of the theory of liability pursuant to which such damages may be sought, including breach of contract, breach of warranty, negligence, or any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law. These exclusions survive in the event such remedy fails of its essential purpose or is otherwise deemed unenforceable. All disclaimers of warranties and limitations of damages appearing in these terms are cumulative, and no disclaimer or limitation appearing in this agreement is intended to limit the scope of effect of any other disclaimer or limitation a appearing in this agreement. Some states do not allow the exclusion or limitation of certain liabilities or damages, so the above limitations or exclusions my not apply to you.

 

CREDIT CARD PAYMENTS

You agree to authorize the ticket issuer to charge your credit card number the amount that is shown as the Grand Total. Dupont World Travel and Tours reserves the right to decline payment by way of 3rd party credit cards and/or international credit cards. At the time of processing your transaction if your credit card declines, we will make all efforts to notify you by way of an email message within 1 business day. The transaction will not be processed if your credit card has declined. The FARE and any other booking details are NOT GUARANTEED until time of issuance. The Client agrees to the following terms and conditions regarding payment by credit.

 AGREEMENT TO PAY
The Client agrees to honor all credit card charges for product purchased from The Agency] prior to the issuance of their travel documents.

 PAYMENT OBLIGATIONS
The Client agrees to pay to The Agency at such place designated by it, obligations evidencing credit extended by The Agency in accordance with the applicable payment, finance and service charge schedule in effect from time to time.

 CHARGEBACKS
The Client agrees not to dispute the processing fee, airline ticket charge or fare adjustment if The Agency and its associates have abided by the terms and conditions of the airlines and this agreement. If The Client is questioning any charge on their credit card, please call or send an email to Dupont World Travel via email to info@traveldupont.com  before disputing the charge with the credit card company. If The Client attempts a chargeback on a non-refundable airline ticket, service fee or a fare adjustment that meets the terms and conditions of the airline and this agreement; The Client agrees to refund the full amount of the chargeback plus a 50% penalty of the total ticket value for the inconvenience and accounting fee. In cases where The Client attempts a fraudulent chargeback, The Client will be responsible for the cost required to initiate legal proceedings in order to recoup the potential loss imposed by The Client.

 GOVERNING LAW
All transactions involving the credit extended under this agreement shall be governed by the laws of the District of Columbia, which are expressly adopted to control all transactions under this agreement.

 WAIVER OF STATUE OF LIMITATIONS
The Client expressly waives the defense of the statute of limitations for the period permitted by law.

 

AGREEMENT OF CUSTOMER

The Client expressly agrees to the provisions contained in this agreement and manifests this agreement by his or her signature. The Client expressly agrees to the terms of this agreement by replying to the email: info@traveldupont.com.

 RECEIPT OF COPY OF AGREEMENT
The Client acknowledges receipt of a copy of this agreement or having read the agreement.

For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance We also strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.
